7. Marketplace and User Interactions
Proxima Drivers provides a showcase and meeting point between users (private and professional operators), but does not act as a financial intermediary, does not process payments, nor does it provide any commercial or legal warranties regarding transactions completed between parties. Agreements on price, vehicle or spare parts condition, payment, and transfer of ownership take place at the exclusive risk and responsibility of the users involved. Proxima Drivers disclaims all liability for overt or latent defects, contractual defaults, failed deliveries, or scams between users.
8. Vehicle History Reports and Anti-Fraud Transparency
The platform enables users to attach historical documents and vehicle certifications (e.g. third-party appraisals, carVertical, Carfax, Dekra reports, maintenance invoices):
- Anti-Fraud Purpose: The uploading of such records has the sole purpose of fostering vehicle history transparency and combating odometer and accident fraud.
- Vehicle-Tied Technical Data: The user expressly acknowledges and agrees that objective technical data (recorded mileage, service dates, VIN number, documented appraisals, and damage history) remain permanently associated with the vehicle chassis to protect the vehicle historical integrity and future buyers, strictly decoupled from any personal identifying information of the user, even in case of vehicle transfer or subsequent account deletion.
- No Warranty of Authenticity & Disclaimer of Liability: Proxima Drivers acts as a hosting and digital storage provider. Proxima Drivers does not perform sworn appraisals nor does it verify the authenticity, accuracy, or truthfulness of documents or mileages submitted by users or third-party providers. The user uploading a document assumes full and exclusive civil and criminal responsibility for its compliance and authenticity.
- Audit and Sanctions: We reserve the full right to conduct random or reported audits, request compliance verifications, remove counterfeit or manipulated documents, and immediately issue a permanent ban to the user, reserving the right to report verified fraudulent activities to the competent legal authorities.
9. Identity Verification (Didit KYC)
To enhance community safety and prevent fake accounts, Proxima Drivers offers users the opportunity to certify their profile through identity verification technology provided by our specialized third-party partner Didit Identity Spain, S.L.:
- The verification procedure is optional, but may be required to access advanced features (e.g. verified seller badge or high-value listings).
- Official ID document capture and 3D facial liveness biometrics are processed entirely and exclusively on Didit encrypted, GDPR-compliant servers.
- Proxima Drivers does not store, view, or retain copies of ID documents or biometric vectors on its own servers or databases. Proxima Drivers only receives and records the binary verification outcome (
is_verifiedflag) and a session reference ID for security and audit purposes.
10. Fuel Prices, Maps, and Geographic Data
Information regarding gas stations and fuel prices displayed in the application is gathered from government open data feeds, third-party APIs, or community reports. Such data is provided purely for orientation purposes without any warranty of real-time accuracy, actual availability at the pump, or pricing fidelity. Proxima Drivers is not liable for price discrepancies, closed stations, or cartographic inaccuracies.
11. Copyright, Trademarks, and Vehicle Manufacturers
All trademarks, logos, trade names, emblems, and vehicle models cited or displayed within the application (including but not limited to: Ferrari, BMW, Audi, Mercedes-Benz, Porsche, Fiat, etc.) are the exclusive property of their respective manufacturers and registered trademark holders.
Proxima Drivers is an independent platform and is in no way affiliated with, authorized, sponsored, or associated with any vehicle manufacturer. The use of automotive trademarks and model names serves solely a descriptive, nominative, and identification purpose of user vehicles in full compliance with nominative fair use doctrine. For any copyright or intellectual property infringement inquiries, please contact [email protected].
12. Road Safety & Prohibition of Use While Driving
The user strictly agrees never to operate or interact with the application while operating any motorized vehicle. Any consultation of maps, chats, or vehicle cards must only take place when the vehicle is stationary and parked in complete safety in compliance with traffic regulations. Proxima Drivers disclaims all liability for road accidents or fines resulting from distracted driving.
